Tineco prevails in ITC patent infringement dispute with Bissell over wet-dry surface cleaning devices
Client(s) Tineco Intelligent Technology Co., Ltd.
Jones Day successfully represented Tineco Intelligent Technology Co., Ltd. as respondent in an ITC Section 337 investigation filed by complainants Bissell Inc. and Bissell Homecare Inc. ("Bissell") relating to wet-dry surface cleaning devices. Bissell asserted five patents that it alleged Tineco's wet-dry surface cleaning devices infringe. Tineco contends that the asserted patents are invalid, and the accused products do not infringe. After a five-day evidentiary hearing in December 2022, the Chief Administrative Law Judge, Clark S. Cheney, concluded in his Initial Determination that there was no infringement by any of Tineco’s current products. On December 18, 2023, the Commission issued its Final Determination affirming the CALJ's Initial Determination in its entirety. Tineco remains free to import all its current products into the United States.
