Hikvision USA secures final judgment and dismissal with prejudice of patent infringement complaint in N.D. Texas

Jones Day secured a final judgment and dismissal with prejudice for our client Hikvision USA, Inc. in a patent infringement case filed in the Northern District of Texas. Jones Day filed an early motion to dismiss the plaintiff's amended complaint, and persuaded Chief Judge Godbey to effectively stay the case and any discovery while he considered the dismissal motion. Judge Godbey agreed with Jones Day's arguments that the plaintiff Contiguity had failed to adequately plead an infringement claim against Hikvision, particularly regarding a material patent claim limitation that had been added during patent prosecution. Judge Godbey rejected the plaintiff's request for leave to further amend the complaint to plead additional infringement facts, noting that Contiguity had already “twice failed to plead facts sufficient to state a claim.”
