Broad Range of Energy Project Construction Experience. Our Energy Delivery & Power lawyers are regularly engaged on behalf of clients to negotiate and document engineering, procurement, and construction contracts for power generation, electric and gas transmission and distribution, pipeline, oil and gas, LNG and petrochemicals projects. Shortages and unprecedented volatility in the prices of raw materials and labor are presenting levels of risk not previously encountered, particularly in certain markets. Our experience, and the fact that we have represented the full spectrum of energy project participants, including owners, lenders, equipment suppliers, contractors, and insurers, enhances our ability to advise on engineering and construction contracts in order to solve a variety of financial and construction risk allocation challenges. Our Energy Delivery & Power lawyers have been involved in documenting construction arrangements for projects in the U.S., Asia, Europe, the Middle East, Latin America, and the Caribbean, and are experienced with traditional, design-build, "turnkey" EPC, cost plus fee, lump-sum fixed price and target price plus incentive fee approaches to construction contracting.
Underlying Contract Documentation And Forms. Our Energy Delivery & Power lawyers are familiar with and have negotiated arrangements using various government forms of construction contracts, as well as the forms published by all major professional and construction industry trade associations. A wide variety of nonstandard project-specific construction contracts for major energy facilities located around the world have also been developed by our team.
Construction Dispute Resolution and Litigation. We are routinely involved in the prosecution and defense of all types of construction claims, including but not limited to contract claims, made by or against owners, developers, contractors, engineers, subcontractors, construction managers, suppliers, manufacturers, design professionals, builders risk insurers, and sureties. Our construction dispute resolution capabilities and experience include representations of clients not only in court, but also in
ad hoc and administered arbitrations, structured mediations, mini-trials, and other forms of ADR (e.g., dispute review boards). In addition, Jones Day lawyers have extensive experience with international arbitration and are familiar with the increasing number of arbitral institutions and bodies of rules through which major construction disputes are resolved. These institutions and rules include ICC, AAA (domestic and international rules), LCIA, SCC, ICSID, WIRO, DIS, UNCITRAL, CIETAC, BAC, HKIAC, SIAC, and JCAA.
