Jay Tambe concentrates his practice in litigation involving securities, derivatives, and other financial products. He is a co-leader of the Firm's financial institutions litigation & regulation practice. Jay has extensive experience in class action litigation under the federal securities laws. In derivatives litigation, he has represented plaintiffs and defendants in claims concerning ISDA swap agreements, including credit default swaps, total return swaps, and commodity swaps. Jay has significant experience litigating claims involving collateralized debt obligations (CDOs) and has successfully obtained dismissal of such claims in the state and federal courts of New York.
Jay routinely provides prelitigation advice to clients on documentation and risk mitigation concerning CDOs, swaps, and other derivative instruments. For the past two years, well before the turmoil in the credit markets in the summer and fall of 2007, Jay advised the Firm's clients about the risks of CDO litigation and worked with certain of the Firm's clients to review and update documentation and sales practices to mitigate litigation risks. Jay continues to be a frequent speaker on CDO and derivatives litigation topics to Firm clients and in various external settings.
A number of Jay's representations have involved litigation or investigation outside the United States. In securities litigation, he often represents non-U.S. issuers. In derivatives and CDO litigation, he also has frequently dealt with cross-border issues. As a result, Jay is well versed in navigating international discovery and judgment enforcement. He also has broad commercial litigation experience under federal and state consumer protection and financial disclosure statutes and the federal antiracketeering laws.
