Trial Practice - Overview

Jones Day's Trial Practice is widely recognized for both the breadth of its knowledge and experience and the depth of its broad array of trial lawyers throughout the world. The practice serves individuals, corporations and related committees, partnerships, and governmental entities across a broad range of business disputes and civil litigation, from counseling through trial and appeal. We have particular single-party, multiparty, and class-action experience involving:

  • Bankruptcy and insolvency, including professional liability, issues.
  • Change-in-control situations, including proxy fights, hostile takeovers, and postclosing adjustments.
  • Commercial, contractual, and construction disputes.
  • Consumer practice complaints.
  • Corporate securities and governance.
  • Financial institutions.
  • Franchise and dealership litigation.
  • Insurance coverage.
  • Libel and the First Amendment.
  • Federal, state, and local regulatory and administrative proceedings.
  • Tax controversies and litigation.

A significant part of our practice deals with complex, multidistrict litigation and coordinated state law proceedings involving multiple adversaries. We are experienced in national coordinating counsel and joint defense roles, as well as alternative dispute resolution approaches, including arbitration and mediation. Because of the breadth and depth of our practice, we often have the ability to handle national litigation in multiple courts with Jones Day lawyers exclusively, as well as the ability and experience to coordinate the work of many lawyers across multiple firms where necessary.

Complex litigation in the 21st century requires mastery of the full range of available litigation support technology to provide persuasive, effective, and efficient service. Gathering, reviewing, and producing electronic mail alone would have dwarfed the complete discovery efforts of cases only a decade ago. Jones Day has remained well ahead of the curve in using technology to get the best results at the lowest possible cost to our clients. To cite just one example, the Firm's extensive electronic discovery experience has been recognized as a leader in the legal world. We also make heavy use of electronic document imaging, storage, and analysis for case preparation and at trial, saving time and expense in cases of all sizes.

Wherever appropriate and efficient, lawyers in the Trial Practice work in conjunction and coordination with other Jones Day litigation practices to handle matters, including our Antitrust LitigationCorporate Criminal Investigations, Health Care LitigationIntellectual PropertyInternational Litigation & ArbitrationIssues & AppealsLabor & EmploymentProduct Liability & Mass TortsSecurities & Shareholder Litigation, and Tax Litigation practices.

The Firm's overall litigation practice today numbers more than 1,100 litigators, including approximately 80 litigators in Europe and 65 in Asia who possess local law and cross-border litigation, arbitration, and mediation experience. We provide services to U.S. companies that fall under foreign jurisdiction as well as non-U.S. companies with operations or sales in the United States. The coordinator of the Firm's Trial Practice is Tim Cullen (Washington).

The accomplishments of Jones Day trial lawyers have been recognized by our peers, by the media and, most important, by our clients. Our peer recognition is best exemplified by the fact that several Jones Day litigation partners are Fellows of the American College of Trial Lawyers: Martha Boersch (San Francisco), Paul Crist (Cleveland), Tim Cullen (Washington), Ted Grossman (Cleveland), Tom Malcolm (Irvine), Patrick McCartan (Cleveland), Sydney McDole (Dallas), Rick McKnight (Los Angeles), Jack Montgomery (Pittsburgh), George Moscarino (Cleveland), Terry Murphy (Dallas), Jack Newman (Cleveland), Brian O'Neill (Los Angeles), Dan Reidy (Chicago), Victor Savikas (Los Angeles), and John B. Williams (Washington).

Media recognition of our trial accomplishments and capabilities is extensive, but we are particularly privileged to have been named the Litigation Department of the Year by The American Lawyer in 2002, a Finalist in 2004, and Honorable Mention in 2006.
