Partners Jonathan Berman and Colleen Heisey contributed a chapter titled "Apter v. Department of Health and Human Services: You are not a horse, and FDA is not a physician," to Food & Drug Law Institute's book: Top Food and Drug Cases, 2023, & Cases to Watch, 2024. The chapter describes how Apter, a case that challenged the Food & Drug Administration's (FDA) authority to advise against the off-label use of ivermectin to treat COVID-19, "breaks new ground and provides a new avenue for challenging the FDA."
