Alderwoods obtains dismissal of plaintiff's Rule 23 state law claims

Jones Day is defending Alderwoods Group, Inc. in this nationwide "off the clock" collective action. The Court granted a motion to dismiss Plaintiffs' Rule 23 state law claims and, in a separate ruling, dismissed Alderwoods' parent corporation, Service Corporation International, from the case. The Court also limited notice under the FLSA to only nine job titles of Alderwoods employees, denying conditional certification as to thousands of additional current and former employees. Discovery on class issue is on-going.
