Client obtains dismissal from claims related to international humanitarian aid program
Client(s) Confidential client
Jones Day acted as principal counsel to a client who sought dismissal of a complaint alleging improprieties related to the administration of an international humanitarian aid program. On February 6, 2013, the United States District Court for the Southern District of New York dismissed the complaint against a number of corporate defendants, including the Jones Day client. The complaint had alleged that a number of defendants who participated in the program engaged in illegal conduct related to the purchase and sale of goods under the program and that this conduct violated a number of federal laws including RICO and the Federal Corrupt Practices Act. The District Court concluded, inter alia, that the Complaint failed to allege causation and that the plaintiff was barred from bringing the action.
