Major commercial construction company settles bid protest relating to assisted living project

Jones Day successfully represented a major Pennsylvania commercial construction company in a bid dispute with the owner of a proposed assisted living facility in Central Pennsylvania. The client was the lowest responsive, responsible bidder for a nearly $14 million USDA-funded construction contract. The owner originally awarded the contract to an alternate bidder who was not the lowest bidder. Within 30 days of the filing of the Bid Protest, the Jones Day team successfully convinced the owner to terminate the contract it had executed with the second low bidder. The owner rejected all previous bids, reopened bid solicitations, and provided the client another opportunity to win the project award.
