Chiquita appeals decision denying insurance coverage
Client(s) Chiquita Brands International, Inc.
Jones Day client Chiquita Brands International, Inc. is challenging a ruling denying insurance coverage for injury to Columbian citizens allegedly caused by Chiquita's conduct. The insurance company alleged that the occurrence was not in the coverage territory, and therefore, the insurance company had no duty to defend. Chiquita filed for discretionary jurisdiction, arguing that the occurrence was in Cincinnati and therefore within the coverage area. Chiquita won at trial but the First District Court of Appeals reversed the decision and the Ohio Supreme Court declined jurisdiction. The case was remanded to the trial court, and is now on appeal to the First District Court of Appeals.
