Jones Day prevailed on behalf of Kraft Heinz Foods Company in a significant arbitration involving a grievance filed by UFCW, Local 538 seeking plant closure retiree medical benefits. After the company announced the closure of its Madison, WI facility, the union filed a grievance on behalf of a class of employees who would reach age 50 by the impending closure of the company's Madison, WI facility seeking over $45 million in retiree health care continuation benefits. After a hearing and substantial briefing, we persuaded the arbitrator to issue an award denying the grievance in its entirety.
