Jones Day represented a major healthcare non-profit organization in obtaining insurance coverage for the cost of defending class action litigation alleging data privacy claims. The non-profit had a cyber policy, as well as two other lines of coverage available, but each of the three insurers refused to pay for the non-profit’s litigation defense. Jones Day negotiated a settlement which required all three insurers to pay defense costs until the claims were ultimately dismissed.
