Medical device manufacturer obtains voluntary dismissal of product liability suit surrounding allegedly defective blood glucose meter

A medical device manufacturer represented by Jones Day obtained voluntary dismissal of a product liability lawsuit in which plaintiffs claimed that a user of one of the manufacturer's blood glucose meters fell and fractured her arm while using the meter to monitor her diabetes. Plaintiffs alleged that the user's injury was caused because the manufacturer was negligent in the manufacturing, design, or marketing of the meter.
Jones Day removed the case to federal court and moved to dismiss the plaintiffs' successive complaints. After a series of negotiations and motion practice, the plaintiffs agreed to voluntarily dismiss their case with prejudice without any payment or accommodation for the plaintiffs.
