Battery Storage secures judgment confirming $18,670,702.50 arbitration award

Client(s) West Chicago Battery Storage, LLC and Joliet Battery Storage LLC

Jones Day clients West Chicago Battery Storage, LLC and Joliet Battery Storage, LLC (collectively "Battery Storage") successfully defended confirmation of a contested arbitration award for $18,670,702.50 against BYD America Corp. The confirmation of the arbitration award also granted post judgment interest and attorney’s fees. In the underlying arbitration, Battery Storage prevailed on breach of contract and breach of warranty claims against BYD America Corp. that arose from a contract to supply battery storage systems for two separate battery storage projects. The project involved (then) new battery technology that Battery Storage sought to utilize in the tightly regulated energy arbitrage space. The parties settled after the award was confirmed.
