W2I Venture successfully defends bid protest concerning D.C. lottery procurement award

Jones Day successfully represented W2I Venture (W2I), a joint venture between international gaming company Intralot and W2Tech, in defeating a bid protest action brought by Lottery Technology Enterprises (LTE) before the District of Columbia Contract Appeals Board (CAB). On April 4, 2008, LTE filed a protest with the CAB seeking to overturn the decision of the District's Office of Chief Financial Officer (OCFO) to award W2I a ten-year contract to operate the District's lottery system (a contract likely to result in well over two billion dollars in gross revenue for the District). Acting in concert with the District's Office of Attorney General, Jones Day argued, through numerous rounds of briefing, that W2I's proposal was technically superior to LTE's, offered some $20 million in savings to the District as compared to LTE's, and that the OFCO's award decision was rational and in full accord with DC procurement law. The CAB agreed, finding LTE's complaints regarding the District's technical and price evaluations, and allegations of favoritism generally, to be without merit.
