International Coal Group obtains dismissal of shareholder class action

Jones Day represented International Coal Group, Inc. and certain officers and directors in a class action alleging disclosure violations regarding mine safety issues in offering prospectuses. The lawsuit was filed on April 5, 2007 in the U.S. District Court in the Southern District of West Virginia. The Amended Complaint asserted claims under Sections 11, 12(a)(2) and 15 of the Securities Act of 1993 based on alleged false and misleading statements in the registration statements filed in connected with the ICG's November 2005 reorganization and December 2005 public offering of common stock. Jones Day obtained dismissal of the complaint in its entirety.
