R.J. Reynolds resolves long-running class action over unfair competition claims

Jones Day client R.J. Reynolds Tobacco Company obtained a settlement resolving a nationwide consumer class action involving consumer promotional programs. R.J. Reynolds originally obtained dismissal of the case under Rule 12. The Ninth Circuit affirmed in part, and reversed in part. On remand, the district court certified a California-only breach of contract class. Discovery was reopened, and the class was decertified based on the new discovery. While that was pending, R.J. Reynolds obtained a nationwide settlement, resolving a case that potentially could have had wide ranging impacts on other consumer loyalty programs.
