GM successfully defends against preliminary injunction proceedings from alleged sale of a dealership
Client(s) General Motors Company
Jones Day successfully defended General Motors LLC ("GM") in preliminary injunction proceedings filed in federal court arising out of an alleged sale of a dealership and related claims involving an arbitration conducted under Congressional legislation. The plaintiffs sought preliminary injunctive relief, claiming that GM had failed to recognize the buyer and failed to issue required agreements to the new dealer. After hearings with the Court and briefing by the parties, plaintiffs withdrew their motion for interim relief and the United States District Court for the Northern District of Iowa granted GM's motion to transfer the matter to the United States District for the Southern District of New York for referral to the Bankruptcy Court handling the bankruptcy proceedings of General Motors Corporation, n/k/a Motors Liquidation. After the transfer, the matter settled.
