AstraZeneca obtains dismissal in class action alleging misclassification

Jones Day earned a quick victory for AstraZeneca in Shatto v. AstraZeneca, in which Plaintiff alleged that he and other pharmaceutical sales representatives nationwide were misclassified as exempt from the FLSA's overtime pay requirements. Jones Day moved for judgment on the pleadings, arguing that Plaintiff's claim that the company willful violated the FLSA should be dismissed given the existence of significant favorable authority on the issue of the exempt status. Jones Day also argued that Plaintiff's claims should be dismissed as time barred due to Plaintiff's failure to file an opt-in consent form. Shortly thereafter, Plaintiff agreed to dismiss the case with prejudice, and on March 23, 2011, the court entered the resulting order.
