Foreign representative successful in enforcement action in Southern District of New York

Jones Day represents the foreign representative of Cozumel Caribe, S.A. de C.V. in its chapter 15 case currently pending before Judge Glenn in the Bankruptcy Court for the Southern District of New York. In this capacity, Jones Day represented the foreign representative in an action filed by Cozumel Caribe's largest creditor against non-debtor affiliate guarantors of Cozumel Caribe's debt before Judge Sweet in the District Court for the Southern District of New York. Jones Day secured a judgment staying the District Court action on the basis of international comity as required by chapter 15 of the Bankruptcy Code.
