Experian prevails in appeal before Sixth Circuit involving alleged inaccuracies in consumer credit report

Jones Day represented Experian Information Solutions, Inc. in an appeal before the Sixth Circuit involving alleged inaccuracies in the personal credit report of a consumer. After the Plaintiff sued, the trial court disregarded the Plaintiff’s affidavit and found no evidence that the Plaintiff had properly disputed the alleged inaccuracies, and no evidence of any damages. On appeal, the Sixth Circuit affirmed, adopting Experian’s argument that the Plaintiff was alternatively barred from recovering as a matter of law because there was no evidence that Experian had published any inaccuracy to a third party.
