Jones Day obtained summary judgment on behalf of Memorial Sloan-Kettering Cancer Center dismissing a discrimination action by a former case manager. The case manager alleged that the defendant had terminated her employment on the basis of her race (African American) in violation of Section 1981, New York Executive Law and New York City Human Rights Law. The plaintiff's theory of race discrimination was that she was held to higher performance standards than her similarly-situated Caucasian colleague. The court found that the plaintiff had not presented disputed evidence that she was held to different standards due to her race, and it consequently dismissed the complaint in its entirety.
