SCI Illinois Services obtains 7th Circuit affirmance of dismissal of federal and state discrimination and retaliation claims

In September 2014, The United States Court of Appeals for the Seventh Circuit affirmed the district court's judgment in favor of Jones Day client SCI Illinois Services, Inc., upholding the dismissal of plaintiff's claims of discrimination (based on race and sex) and retaliation under Federal and Illinois law. In September 2013, the district court granted summary judgment in favor of SCI on all of plaintiff's claims because there was no genuine dispute of material fact as to whether SCI's reason for terminating plaintiff was a pretext for discrimination and because she could not establish a causal connection between her alleged protected conduct (i.e., internal complaints) and her termination. Approximately one year earlier, the district court also granted SCI's motion to dismiss Plaintiff's Title VII race discrimination claim and her state-law race and sex discrimination claims, holding that her Title VII claim was beyond the scope of her EEOC charge and, with regard to her Illinois state law claims, she failed to exhaust administrative remedies before proceeding in court.
