Jordan Aviation avoids foreclosure sale by CTS Engines

Jones Day was retained by Jordan Aviation, an airline based in Amman, in connection with litigation for breach of contract pending in a Florida state court. Jones Day was brought in on an emergency basis and was successful in delaying a final order of judgment and the imminent foreclosure sale of Jordan Aviation’s two jet engines based on the entry of a default judgment against the company. Following the presentation of various defenses highlighting numerous procedural errors, including improper service of process on Jordan Aviation as a foreign defendant and plaintiffs' failure to comply with the mandatory arbitration provision in the parties' contract, the parties reached a settlement, which ultimately led to dismissal of the lawsuit.
