Jones Day represented a national restaurant chain in this class action lawsuit brought against them and one of their franchisees, alleging violations of the Fair Credit Reporting Act. Plaintiff alleged that the defendants were joint employer and that they had engaged in a practice of obtaining consumer reports for prospective and current employees without proper authorization and disclosure. Plaintiff also claimed that defendants, as joint employers, took adverse actions against applicants or employees without providing advance notice and copies of the consumer report to those applicants and employees. After a brief period of informal discovery, the matter was resolved favorably for defendants and the case was dismissed.
