Global payroll company defeats putative class action suit over payroll transaction fees

Jones Day obtained dismissal of a putative class action case of first impression involving the legality of using pay cards to pay employees for a global payroll company. The putative class action was filed in federal court in Pennsylvania, alleging that paycard transaction fees were unlawful deductions under the Pennsylvania Wage Payment and Collection Law. The judge dismissed the suit, finding that the class representative did not (and could not) allege sufficient facts to establish that the global payroll company was an agent of the class representative’s actual employer.
