Red Sox prevail in first-ever foul ball trial
Client(s) Fenway Sports Group
Jones Day prevailed on behalf of the Boston Red Sox in a two-week jury trial brought by a fan who was hit by a foul ball in an upper-level premium seating area of Fenway Park. The case was the first jury trial in Massachusetts regarding a foul ball injury, and included testimony by five experts in addition to several senior Red Sox executives. The jury took only a couple of hours to decide that the Red Sox were not negligent in their construction and maintenance of Fenway Park.
