DIRECTV wins dismissal of wage and hour claims in alleged joint employer case
Client(s) DIRECTV Group, Inc., The
Jones Day successfully obtained dismissal of wage and hour claims against DIRECTV in an alleged joint employer case brought forth by former employees. The plaintiffs alleged that DIRECTV was their joint employer and was liable for alleged violations of the Fair Labor Standards Act, the Illinois Minimum Wage Law, the Illinois Employee Classification Act, and the Illinois Wage Payment and Collection Act. The District Court Judge dismissed plaintiff's claims, finding Plaintiffs have not sufficiently plead facts to sustain a joint employer relationship between DIRECTV and its sub-contractors, for whom Plaintiffs worked. Plaintiffs were granted leave to re-plead their claims only if they did so in accordance with Rule 11.
