UPMC prevails before the Pennsylvania Supreme Court

Following a decision from the Pennsylvania Commonwealth Court, Jones Day led an expedited appeal to the Pennsylvania Supreme Court that resulted in a complete victory for the University of Pittsburgh Medical Center ("UPMC"), one of the nation's preeminent integrated healthcare systems. The case arose from a Consent Decree between UPMC and the Commonwealth of Pennsylvania. On behalf of the Commonwealth, the Pennsylvania Attorney General sued UPMC seeking to force UPMC to remain in certain contractual arrangements with Highmark Inc., the Blue Cross Blue Shield licensee in Western Pennsylvania.
The Commonwealth Court granted the Attorney General's request, which effectively required UPMC to remain in-contract with Highmark over UPMC's objection. Jones Day then represented UPMC in appealing that decision to the Pennsylvania Supreme Court. Following expedited briefing and argument, the Supreme Court unanimously adopted UPMC's interpretation of the applicable contract provisions, rejected the positions of both the Attorney General and Highmark, and reversed the Commonwealth Court's decision.
