U.S. Chamber of Commerce files amicus brief in support of Ford post market duty to warn case

Jones Day filed an amicus brief on behalf of the U.S. Chamber of Commerce in support of Ford Motor Company in a post market duty to warn case. Plaintiffs argued that Ford knew of the risk from the fuel sender unit and fuel tank placement in Crown Victoria vehicles routinely driven by police. The Ohio Supreme Court held that while the plaintiffs had arguably established that there was a risk of fire eruption when the vehicle was struck from behind, they did not provide sufficient evidence from which the jury could consider the likelihood of the risk.
