DME company resolves criminal and civil investigation

Jones Day represented a durable medical equipment company in a criminal and civil False Claims Act investigation regarding its sales to the Veterans Administration and the Department of Defense. The case began with a search by federal agents of the company's headquarters, followed by issuance of a Civil Investigative Demand, and involved country of origin and pricing of its products to federal agencies. We were able to resolve the matter with a modest monetary civil payment with no criminal action against the company or its current executives, no corporate monitor, and no debarment from federal programs.
