Experian obtains complete summary judgment victory in FCRA litigation

Jones Day client Experian Information Solutions, Inc. obtained summary judgment on all claims brought against it by a consumer alleging that Experian had inaccurately reported a collections account on her consumer disclosure. The plaintiff alleged that Experian had negligently and willfully violated the Fair Credit Reporting Act (15 U.S.C. 1681 et seq.), despite having received confirmation from the data furnisher that the debt was valid and was accurately reported. Experian successfully argued in its motion for summary judgment that its reporting of the account was accurate, and that the Plaintiff had wholly failed to produce any evidence or testimony supporting her claims that the debt was not hers or was inaccurately reported.
