National bank victorious as California Court of Appeal reverses trial court and upholds arbitration agreement in employment dispute

Jones Day successfully obtained enforcement of an arbitration agreement against a former executive vice president of a national bank, following appeal of a trial court order denying a motion to compel arbitration on the grounds the arbitration agreement was unconscionable. The court of appeal reversed the trial court decision and directed the court to enter a new order enforcing the arbitration agreement, after holding that the plaintiff had consented to be bound to a valid arbitration agreement and rejecting all the trial court’s findings that the agreement was both procedurally and substantively unconscionable.
