International wind-farm developer defeats take-over attempt by prime contractor

Jones Day successfully defended one of the world's largest developers of wind-farm projects against a potentially dispositive application for interim measures under the ICC’s Emergency Arbitrator Rules. The application – brought by the general contractor of the client’s leading project in Mexico – sought to oust the client from its role as balance-of-plant subcontractor through the exercise of step-in rights allegedly triggered by progress delays in construction. Jones Day defeated the application and secured an award of attorneys fees, leading to a settlement agreement.
