U.S.-based oil and gas company prevails in recent Gorgon project arbitration

Jones Day successfully represented the Owner in an ad hoc UNCITRAL arbitration arising from one of the world's largest LNG projects, and the largest single resource project in Australia's history. The Owner faced a claim valued at its highest in excess of AU$2.1 billion from the contractor consortium responsible for the design and build of the project's LNG loading jetty. The dispute involved hundreds of discrete claims concerning complex issues of marine construction, delay and disruption, defective performance, a modified total cost claim, weather impacts, and environmental regulations. After six weeks of evidential hearings, the Owner was successful in defeating more than 95% of the overall claim value.
