LensCrafters defeats insurer challenge to coverage for data privacy class actions

Client(s) Luxottica Retail North America

Jones Day represented Luxottica Retail North America and its affiliate LensCrafters in obtaining insurance coverage under a Managed Care E&O Policy for the cost of defending consumer class action litigation. Jones Day filed a complaint against the insurer, Allied World, and then obtained a favorable ruling from the U.S. District Court rejecting several of the insurer’s coverage defenses. Luxottica has recovered a portion of its defense costs from the insurer, and additional claims are pending.
