Erie defends claims in auto body shop MDL proceeding
Client(s) Erie Indemnity Company
Jones Day is defending Erie Indemnity Company affiliates Erie Insurance Exchange and Erie Insurance Company (together, "Erie") in three federal antitrust lawsuits pending in multidistrict litigation. The MDL proceeding encompasses claims from hundreds of auto body shops in twenty lawsuits consolidated for pretrial purposes. The plaintiffs allege that dozens of insurers conspired to depress the rates for auto repair services, in violation of the Sherman Act and of state laws relating to unjust enrichment and tortious interference.
Jones Day has defended Erie in the MDL proceeding since 2015, successfully moving to dismiss the complaints, and is representing Erie on appeal in the Eleventh Circuit.
