Plurimi wins dismissal of federal litigation surrounding revolving credit agreement for lack of jurisdiction

Jones Day represented Plurimi Investment Managers LLP, a British investment firm, in a federal court action alleging that Plurimi had breached a revolving credit agreement with an Ohio company. Plurimi moved to dismiss on several grounds, including lack of jurisdiction. After full briefing, the court ordered an evidentiary hearing, and on February 27, 2018 issued a decision finding that the court had no personal jurisdiction over Plurimi because the Plurimi employee who signed the agreement lacked actual or apparent authority to bind Plurimi to such an agreement, and had insufficient contacts with the United States to establish that Plurimi had purposefully availed itself of Ohio's laws.
