Jones Day obtained dismissal of a misclassification claim filed on behalf of all engineers and programmers under the California Private Attorneys General Act. The plaintiff asserted he and other engineers and programmers were misclassified as exempt employees and were entitled to unpaid overtime and penalties for violation of numerous California Labor Code provisions based on the California Private Attorneys General Act (PAGA). After months of litigation and discovery, the lawsuit was dismissed and resolved on an individual basis.
