Med-Trans wins full dismissal of consumer class action in Florida

Jones Day represents a network of life-saving emergency air transport carriers that includes Med-Trans Corp. (“Med-Trans”) against claims filed in various jurisdictions around the United States alleging that air ambulance carriers charge improper fees for their services. Jones Day filed a motion to dismiss all of the claims brought by a putative class of consumers in Florida on the basis that they were preempted by the federal Airline Deregulation Act of 1978. After extensive briefing, the federal district judge granted the motion in full and dismissed the case, securing Med-Trans an early victory.
