Prisoner wins appeal reversing denial of counsel decision in constitutional case

Jones Day represented a prisoner suffering from mental illness and learning disabilities who sought the assistance of counsel to litigate his constitutional claims against Wisconsin prison officials. Despite the prisoner's mental illness and manifest inability to litigate the case on his own, the district court refused to recruit counsel to help him press his claims. On appeal, Jones Day represented him pro bono and obtained a unanimous reversal of the district judge's order. He will now have a chance to obtain the assistance of counsel to present his claims in the district court.
