Park Place Technologies secures trial win with full dismissal of all claims brought by former executive

Jones Day client Park Place Technologies, LLC ("PPT") was successful against all claims in an arbitration filed with the American Arbitration Association by a former executive challenging for cause termination.
Former Chief Financial Officer of a leading data center maintenance company alleged breach of two contracts and several Ohio state law tort claims, including unjust enrichment, fraud, and infliction of emotional distress, relating to his termination. Prior to the arbitration, Jones Day successfully secured dismissal of several of the tort claims against PPT and denial of the claimant’s motion for summary judgment.
After trial and post-trial briefs, retired Judge Peggy Foley Jones of the Cuyahoga County Court for Common Pleas issued a lengthy decision in PPT’s favor on all counts and all claims, holding that PPT did not breach any contract by terminating the former executive and finding no evidence presented at trial supported his claim that PPT or the President exhibited extreme or outrageous conduct necessary to constitute infliction of emotional distress.
