NXP whittles down competitor's infringement suit involving RFID technology from 26 to four patents
Client(s) NXP Semiconductors N.V.
Jones Day defended NXP USA, Inc. in a lawsuit brought by its competitor Impinj, Inc. alleging infringement of 26 patents relating to different aspects of radio frequency identification (RFID) technology. Jones Day successfully narrowed the lawsuit down to only two patents being asserted against NXP through dispositive motions and inter partes review (IPR) proceedings before the United States Patent Trial and Appeal Board (PTAB). After a jury verdict against NXP, Jones Day obtained a new trial addressing the invalidity of one of the asserted patents, successfully defended against the issuance of an injunction based on the jury’s finding of infringement for the second asserted patent, and reduced the damages award by one third of the jury award before the matter was resolved in early 2024.
