Experian obtains Ninth Circuit affirmance in significant FCRA matter

Defending Experian Information Solutions, Inc. in multiple consolidated actions, Jones Day obtained summary judgment in the bellweather action in the District of Arizona, and preserved that success on appeal in the Ninth Circuit. In the first case of its kind to receive a circuit court of appeal opinion, the Ninth Circuit affirmed Jones Day's argument that, to trigger a duty to reinvestigate under the Fair Credit Reporting Act, a dispute must be submitted by the consumer "directly" to the consumer reporting agency; otherwise, the consumer reporting agency has no duty to conduct a reinvestigation.
