Global pharmaceutical client wins ICC arbitration arising from collaboration dispute

Jones Day successfully defended a multinational, pharmaceutical client against a $300-plus million breach-of-contract claim arising from a collaboration agreement and that alleged among other things a failure to use commercially reasonable efforts. After a lengthy evidentiary hearing held remotely during the COVID-19 pandemic, the Tribunal ruled unanimously in our client's favor and ordered the other side to pay our client several million dollars in attorneys’ fees and costs.
