BMS secures EPO precedential victory on epitope claims

Jones Day successfully represented licensee Bristol Myers Squibb’s wholly owned subsidiary Celgene Corporation in the defense of European patent EP 2812443 directed to CD47 antibodies defined by a conformational epitope, in opposition proceedings at the European Patent Office, triggering the first decision that acknowledges patentability of conformational epitope claiming in Europe.
