Telehealth provider obtains dismissal of complaint before state regulatory board
Client(s) Telehealth provider
Jones Day represented a telehealth provider in responding to a complaint filed with a state regulatory board. The anticompetitive complaint filed by a trade association alleged that the telehealth provider’s innovative service offering did not comply with state law during the COVID-19 pandemic. Jones Day opposed the complaint, arguing that the telehealth provider complied with state law in offering essential services during COVID-19, that the state board lacked jurisdiction and was not impartial, and that barring the telehealth provider could violate federal antitrust laws. The board dismissed the complaint.
