Jones Day represented a medical imaging and information systems provider in connection with a False Claims Act investigation regarding laboratory software. In the fall of 2018, the United States Department of Justice issued a civil investigative demand concerning allegations that the company submitted false claims to the government by knowingly providing laboratories with software that had design and performance flaws. The government’s investigation focused on FDA compliance and later, compliance with meaningful use requirements. Jones Day made several presentations to the government educating the government as to why the company’s practices were compliant. In July of 2020, the Department of Justice notified Jones Day that it was terminating the investigation and would not be taking further action.
