BioMarin successfully resolves noncompete dispute

Client(s) BioMarin Pharmaceutical Inc.

Jones Day filed a declaratory relief action on behalf of BioMarin Pharmaceutical Inc. to have the court determine if its employee's noncompete agreement was unenforceable. After litigating the matter for numerous months, a settlement was reached that permitted client to remain an active employee of BioMarin. This case was of significant importance to BioMarin because it permitted the company to hire experienced sales people in California to promote its new product, without fear of protective litigation from a staunch competitor.
