Jones Day represented a Dallas-Fort Worth based hospital system in an investigation of claims asserted by a qui tam relator under the federal False Claims Act. The relator had alleged that the system had violated the federal Anti-Kickback Statute by willfully providing remuneration to induce referrals, and the resulting claims for payment to Medicare and Medicaid created liability under the FCA. After Jones Day defended the health system throughout the investigation, both the United States and the State of Texas declined to intervene, and the relator voluntarily dismissed the case.
